Section 2 Personal Accident WHAT IS COVERED If you sustain injury during a trip and as a direct result of that accident you: - die - lose one or more limbs or your sight - become permanently disabled and are unable to do any type of paid work we will pay a maximum of one of the following benefits to you or your legal personal representatives: - Death - £15,000 - Loss of one or more limbs at or above the wrist or ankle and/or the permanent loss of sight in one or both eyes - £15,000 - Permanent total disablement - £15,000. Section 11 Legal Expenses DAS Legal Expenses administer claims under this section. (For the purpose of this section only "we, us, our" shall be DAS Legal Expenses Insurance Company Limited) DEFINITIONS APPLICABLE TO THIS SECTION ONLY Appointed lawyer The lawyer, or other suitably qualified person, who has been appointed to act for you under Condition I of this section. Legal costs All reasonable and necessary costs charged by the appointed lawyer on a standard basis.Also the costs incurred by opponents in civil cases if you have to pay them, or pay them with our agreement. Date of occurrence The date of the event which may lead to a claim. If there is more than one event arising at the same time or from the same cause, then the dote of occurrence is the date of the first of these events. WHAT IS COVERED We will pay you the necessary and reasonable professional costs and expenses you have to pay to pursue a civil claim against someone else for damages, specific performance or injunction arising from your death or injury outside of the United Kingdom. This section covers you. We agree to provide the insurance in this section as long as: - any legal proceedings will be dealt with by a court or other body which we agree to; and - in civil claims it is always more likely than not that you will recover damages (or other legal remedy) - the date of occurrence of the insured incident happens during the period of insurance. For all insured incidents we will help in appealing or defending an appeal as long as you inform us within the time limits allowed that you want to appeal. Section 7 Missed Departure WHAT IS COVERED We will pay the necessary and reasonable additional costs of accommodation and travel to allow you to continue your trip if: - there is a strike, civil disturbance, mechanical breakdown or adverse weather which interrupts public transport services - the car you are travelling in has an accident or breakdown on the way to the airport, station, or port you are leaving from and as a direct result you arrive too late to start the trip. Section 5 Personal Liability WHAT IS COVERED We will pay any amounts you are legally liable to pay in respect of injury to any person occuring during a trip provided that they: do not work for you are not a member of your family or of your household are not an insured person. We will also pay any amounts you are legally liable to pay for any damage you cause to someone's property during the trip provided that it: does not belong to or is not being looked after by you, your family. your household, or anyone that works for you. The most we will pay for any one claim under this Section is £2,000,000 including costs and expenses. WHAT IS NOT COVERED The first £200 of each and every claim for any damage to rented, leased, hired or borrowed accommodation. Section 9 Catastrophe WHAT IS COVERED We will pay the necessary and reasonable additional costs of accommodation and travel to allow you to: continue your trip or return home if you cannot continue the trip if you are forced to leave the pre-booked and prepaid accommodation because of fire, lightning, earthquake, storm, tempest, hurricane, flood, explosion, medical epidemic or local government directive. The most we will pay in total for each insured person is £400. This is reduced to £250 if they are aged 3 to 16 . General Exclusions (that apply to the whole Policy) THIS POLICY DOES NOT COVER 1. Radioactive Contamination any expense, consequential loss, legal liability or damage to any property directly or indirectly arising from: a) ionising radiations or contamination by radioactivity from any nuclear waste from combustion of nuclear fuel b) the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component. 2. War Risks any consequence of war, invasion, act of foreign enemy, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military force, usurped power, or travel to a destination where the Foreign & Commonwealth Office has advised against "all travel" or travel "unless on essential business': 3. Date Related Computer Failure this Policy does not cover any claim, loss. liability or expenses caused by or arising from, directly or indirectly or in any way relating to, the failure of any computer, data processing equipment or media, microchip, integrated circuit or similar device or any computer software, whether your property or not, to: a) correctly recognise any date as its true calendar date b) capture, save or retain, and/or correctly t o manipulate, interpret or process any data or information or command or instruction as a result of treating any date otherwise than as its true calendar date c) capture, save, retain or correctly to process any data as a result of the operation of any command which has been programmed into any computer software, being a command which causes the loss of data or the inability to capture, save, retain or correctly to process such data on or after any date but this shall not exclude subsequent loss or damage to your property specifically insured by the Policy or any loss not otherwise excluded which itself results from: fire, explosion, lightning, smoke, aircraft or other aerial devices dropped from them, theft or attempted theft, impact by any road vehicle, train or animal, riot, civil commotion, strikers, locked-out workers or persons taking part in labour disturbances, malicious people or vandals, storm or flood, escape of water from any tank, apparatus or pipe, escape of fuel oil from any fixed oil-fired heating installation if covered by this Policy. General Conditions (that apply to the whole Policy) 1. Claims Procedure (your duties) When you become aware of a possible claim under this Policy you should: a) check the appropriate section of the Policy to make sure you have done all the things you must do b) advise us as soon as possible and in any event within 30 days in writing giving full details and complete our appropriate claim form if required c) at your own expense provide us with any receipts, proof, documents or other evidence that it would be reasonable for us to ask for concerning the claim d) at your own expense provide all other information in a form that we choose it would be reasonable for us to ask for e) submit to a medical examination at our expense when and as often as it would be reasonable for us to ask you to f) take all reasonable and practical steps to recover any articles lost or stolen. 2. Claims procedure (our rights) If you make a claim under this Policy a) we have the right to the salvage of any property covered under this Policy b) we can take over: - your rights against another person before or after we have paid a claim - the defence or settlement of any claim against you by another person. 3. Other insurance If at the time of a claim there is another policy covering anything insured by this Policy, we will only pay our proportionate share. This does not apply to Section 2 Personal Accident. 4. Reasonable care You must take all reasonable steps to: - prevent damage or accident - protect the articles insured - avoid injury, illness or liability. 5. Change of information You must tell us about any change in the information upon which this Policy is based. This includes (but is not limited to) telling us about changes in the health of any insured person. Failure to do so could invalidate the Policy. 6. Fraud If you or anyone acting for you makes a claim under this Policy knowing the claim is false or exaggerated in any way, we will not pay the claim and this Policy will cease. 7. Arbitration Other than for claims under Section 2 Personal Accident. If there is a dispute about the amount we wish to pay you for a claim under this Policy, the dispute shall be referred to an arbitrator. The arbitrator will be appointed in accordance with the statutory provisions in force at the time. The arbitrator must have made an award before you can take further action against us. 8. Cooling off and cancellation If you decide within 14 days of taking out this Policy that it does not meet your requirements, we will refund the premium you have paid provided that you give us back the Schedule and any other documents we have issued, there are no claims notified or pending, and you advise us prior t o the commencement of travel We may cancel this Policy at any time by writing to you at the last known address we have for you, giving 14 days notice. If we do this and you have made no claims we will refund a proportionate amount of the premium you paid, depending on the amount of time remaining on the Policy You may only cancel the Policy with our agreement. We will decide if any refund of premium can be allowed. 9. Agreeing to the conditions You agree that you will observe all the terms and conditions, duties and rights that are set out in this Policy. If you do not observe them then the cover will not operate and we will not be able to pay any claims. 10. Law applicable Unless we have specifically agreed differently with you this Policy will be governed by the laws of England and Wales. 11. Rights of Third Parties A person or company who is not a party to this Policy has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Policy but this does not affect any right or remedy of a third party which exists or is available apart from that Act. | |||
